These Conditions of Sale regulate the offer and sale to the consumer of products through the website ilmanovale.com (hereinafter the “Site”) owned by Il Manovare srl and are formulated and provided in compliance with any law applicable to e-commerce.

1. PARTIES TO THE CONTRACT – COMMERCIAL POLICY
The parties to the contract are:

The “Customer” or “Buyer”: the final consumer, or any physical person who purchases through the Site
2. APPLICATION AND AMENDMENTS TO THE CONDITIONS OF SALE
Before making purchases through the Site the Customer declares to have read and understood these Conditions of Sale as well as all the indications provided during the purchase procedure and the contents of the following sections: Terms of Use, Privacy Policy and accept them entirely without any reservation.
Il Manovale reserves the right to vary the contents of these Terms of Sale and of the other documents listed above, highlighting them within the Site. We therefore invite you to periodically consult the Site to verify the presence of any updates or changes. Any change will be effective after publication on the Site.
The Conditions of Sale applicable to a purchase will always be those in force at the time the order is placed.
3. CHARACTERISTICS AND PRICES OF PRODUCTS
The characteristics of the products are presented on the Site within each product sheet. The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is placed. Product prices may be subject to changes and variations. We invite you to check the final sale price before submitting the relevant order form confirming your purchase.
The prices indicated on the Site must be understood as inclusive of VAT and, unless expressly indicated, do not include any additional costs for shipping and delivery that, where applicable, are however communicated to the Customer through special indications on the Site and called during the purchase procedure.
4. METHOD OF CONCLUSION OF THE CONTRACT
To purchase one or more products on the Site, the Customer must fill in and send electronically to Il Manovale the corresponding order form (hereinafter “Purchase Order”) following the instructions progressively provided during the purchase procedure. All the stages of the purchase procedure are clearly described through the pages of the Site and the related texts and graphics.
In the Purchase Order, displayed in its entirety immediately before the conclusion of the contract and in any case before making any payment, is provided summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or charges) and any applicable shipping costs and/or charges.
With the electronic transmission of the Purchase Order, the Customer accepts unconditionally and undertakes to observe the present Conditions of Sale in the dealings with the Manovale concerning the purchase.
After receiving the Purchase Order, Il Manovale will check the availability of the product ordered at the result of this verification will send the Customer by email a confirmation of receipt of the Order.
The sales contract is deemed concluded and completed at the time when Il Manovale sends the Customer by email the confirmation of receipt of the Purchase Order completed and transmitted by the Customer, after verification of the correctness of the data provided and transmitted.
The Purchase Order will be filed at our database for the period necessary for the evasion and in any case no later than the terms of law.
Manovale reserves the right not to execute Purchase Orders that are incomplete or incorrect or not consistent with the commercial policy of these Conditions of Sale, as well as in the event of the unavailability of the products ordered. In these cases we will inform you that the contract has not been concluded and that Il Manovale has not acted on the Purchase Order specifying the reasons.
In particular, if the products presented on the Site are no longer available or on sale at the time of your access to the Site, or at the time of sending the order form, Il Manovale will promptly inform you of any unavailability of the Products. In such cases the contract will not be finalized and, if already concluded for any reason, it will be automatically terminated and no amount will be charged to you.
Qualsiasi responsabilità contrattuale o extracontrattuale per danni diretti o indiretti a persone e/o cose provocati dalla mancata accettazione di un ordine per i motivi di cui sopra viene espressamente esclusa.
5. DISPATCH AND DELIVERY
The products purchased through the Site will be delivered by Il Manovale by courier to the address indicated in the Purchase Order within four working days from the moment of receipt of payment relating to the order.
For orders of less than Euro 46,00 shipping costs are equal to Euro 5,99 while for orders of equal or greater than Euro 46,00 the delivery is free.
6. PAYMENTS
Payment can be made:
(i) with credit card belonging to the Visa and Mastercard circuit
(ii) by bank transfer to IBAN IT88X0542441740000001023817
(iii) through the Paypal platform, selecting it during the purchase process, you will be redirected to secure Paypal servers where accessing with your credentials you can complete the payment by debit card, bank account or electronic purse.
In case of payment by credit card, the price for the purchase of the products and any shipping costs will be charged at the time of shipment of the purchased products.
In case of payment with Paypal, the actual charge will be made at the time of sending by Il Manovale the order confirmation email
Financial information (for example, the credit/debit card number or the date of its expiry) will be forwarded, via encrypted protocol, to banks that provide the related electronic payment services at a distance, without third parties being able, in any way, have access to it. This information, moreover, will never be used by Il Manovale except to complete the procedures related to your purchase and to issue refunds in case of any returns of the products, following exercise of your right of withdrawal, or where it is necessary to prevent or report to the police the commission of fraud through the Site.
7. RIGHT OF WITHDRAWAL (art. 52 e ss. d.lgs. 6 settembre 2005 n.206)
The Buyer shall have the right to exercise the right of withdrawal from the Contract within 10 (ten) working days from the day on which he received the Products purchased on the Site.
The right of withdrawal must be exercised with a return request to the email address shop@ilmanovale.it to which Il Manovale will respond by sending a return form, to be returned filled in all its parts.
The Products must be returned and received by the Seller within 30 (thirty) working days from the date of their receipt.
The only expenses due by the Buyer for the exercise of the right of withdrawal pursuant to this article are the shipping costs.
The right of withdrawal shall be deemed to be exercised correctly by the Customer if all the following conditions are met:
-the Return Form must be correctly filled in and sent to the Seller;
-the Products must not have been opened, the packaging seals must not be altered and/or damaged;
-wrappers and labels must be in perfect condition;
-Products must be returned in their original, perfectly sealed packaging
-Returned Products must be sent to the Seller in a single shipment. The Seller reserves the right not to accept items of the same order, returned and shipped at different times;
In the event that the Buyer has exercised the withdrawal in accordance with the provisions, the Seller will refund the full price of the Products purchased, while the shipping costs for the original delivery of the Products purchased will not be refunded, except where the return of the Products results from a cause attributable to the Seller which has been properly documented.
In particular, once the Seller has received the Buyer’s return and checked that all requirements have been met, the Seller will activate the refund procedures to the Buyer within 30 (thirty) working days from the date on which the Seller became aware of the Buyer’s exercise of the right of withdrawal.
It is understood, of course, that the actual time for the crediting or the refund of the sums paid by the Buyer for the purchase of the Products will also depend on the credit/debit card used. It is also understood that if there is no correspondence between the recipient of the Products indicated in the Order Form and who made the payment of the sums due for their purchase, the refund of the sums resulting from the withdrawal of the Buyer will be executed by the Seller against the person who made the payment.
In the event that the Buyer has not exercised the withdrawal in accordance with the previous provisions and the Buyer’s return cannot be accepted as not complying with the above conditions, the Seller shall inform the Buyer by e-mail. In this case, the Buyer may choose, communicating by e-mail to the Seller, to have the Products purchased at his own expense; in the event that the Buyer is not interested, the Seller reserves the right to retain the Products and the corresponding amount for the purchase of the Products themselves.
